The Financial List, a specialist cross-jurisdictional list set up to address the particular business needs of parties litigating on financial matters, became operational yesterday on 1st October 2015.
It draws on the expertise of judges from both the Chancery and the Queen’s Bench Divisions, with the objective of ensuring that cases which would benefit from being heard by judges with a particular specialism in the financial markets will be streamlined and managed by a single specialist judge from either of those jurisdictions.
A market test case scheme is also being introduced – for the moment on a pilot basis – to enable qualifying claims to be determined by the court without the need for an existing cause of action, where the parties simply wish to obtain clarification on a point of law. In this way, the Financial List will support home-grown and international businesses by providing a forum for efficient, specialist, and high quality financial dispute resolution.
