Before Her Honour Judge Murfitt sitting at the County Court at Chelmsford on 4 February 2020

Upon hearing Counsel for the Applicant and the Respondent in Person

And Upon the Applicant’s application to commit the Respondent for breaches of the Specific Issue Order dated 11 January 2019 to which a penal notice was attached on 7.8.2019 (“hereafter the order”) requiring him to ensure that the child AN attends the King Harold Academy School until further order

And Upon the Respondent admitting service of the order.

And Upon the Respondent having made the following admissions:

That he did not as ordered ensure that the child AN attended the King Harold Academy School, either from the end of the February 2019 half-term holiday, or at all thereafter, and that without applying to the Court to vary the order, or informing Bahar Nazemi (who also holds parental responsibility for the child) he continued to home tutor the child, until October 2019 when he entered him into a different school of his own choosing.


1. The Respondent is found in contempt of court in respect of the breaches admitted as set out above and detailed in the Form N78, such admissions amounting to breaches of paragraphs 3 and 4 of the order of 7 August 2019 (which amended para B35 of the 11.1.2019 order)

2. The Respondent is sentenced with a fine in the sum of £250.00, such fine to be paid with 14 days of the date of this order

3. The Respondent to make payment of the fine to HMCTS, Priory Place, New London Road, Chelmsford, Essex CM2 0PP by 26 February 2020.
