COMMITTAL STATEMENT OF REASONS FOR THE PURPOSE OF CPR R.81.28(5)
Following admissions by him the Court has found GEORGE HARRY NICHOLAS guilty of a breach of the Anti-Social Behaviour Injunction dated 10th December 2019 made pursuant to the Anti-Social Behaviour Crime and Policing Act 2014 and sentenced him to 28 days, suspended for 3 months.
The Defendant deliberately entered into 33 Greenleas, Sunbury TW16 7PQ on 25th January 2020 knowing that his action constituted a breach of the above-mentioned order.
A suspended custodial sentence has been imposed because the breach was deliberate (culpability B) but the harm was category 3 (minor). In mitigation the Defendant admitted his breach on arrest, when brought before the Court on 26th January 2020 and before the Court today. He has put forward a consistent explanation on each occasion. For the latter reasons the sentence was suspended for 3 months.
The Defendant wished for the matter to be dealt with by the Court today and did not wish a further adjournment. The Claimant too wanted the matter dealt with today.
