UPON hearing an oral application on behalf of the Petitioner for the hearing in private of that part of the evidence of XXX that relates to confidential negotiations of non- parties to these proceedings

AND UPON the Court accepting that that part of the evidence involved confidential and sensitive information of non-parties and that their confidentiality would be damaged by publicity and that by no means other than a hearing of that part of the evidence in private would the confidentiality be adequately protected

AND UPON no other person present in court wishing to be heard on the question of whether that part of the evidence should be heard in private

AND UPON the Court being satisfied of the matters set out in paragraph (c) of CPR Rule 39.2(3) and that it is necessary to sit in private to hear the Applications in order to secure the proper administration of justice

IT IS ORDERED that:

  1. The evidence of XXX about the confidential negotiations of non-parties to these proceedings be heard in private.
  2. Pursuant to CPR Rule 39.2(5) this Order shall be published on the website of the Judiciary of England and Wales.
