Arshdeep (claimant/respondent) –v- Buttar Contsruction Ltd (4th defendant/appellant)

The Fourth Defendant (D4) appeals the order of HHJ Bird QC dated 10 June 2021 sitting as a High Court Judge in the Queen’s Bench Division, by which he ordered both D2 and D4 to make interim payments of 150,000 pounds and for both D2 and D4 to each pay 10,000 pounds on account of the Claimant’s costs.
The Claimant is Mr Arshdeep (C). C is an Indian national who suffered injuries rendering him tetraplegic as a result of an accident on a construction site on 21 August 2020. Proceedings were issued against four defendants on 18 February 2021. C issued an application for an interim payment on 22 April 2021 which was pursued against D2 and D4 in order to obtain funds for specialist spinal injury rehabilitation. HHJ Bird QC granted the application and D4 now seeks permission to appeal.
