Background

The Claimant is a Norwegian company specialising in automated warehousing technology.  The majority of the Defendants are part of the Ocado group of companies, whose primary business is the development of warehousing and distribution technology.  There are a number of disputes between the parties, all pending litigation in various jurisdictions.

Within an action for infringements of six of the claimant’s patents, the Appellant/Defendants made an application for an interim injunction to restrain the disclosure of information to the International Trade Commission in the United States on the basis that the information comprised confidential communications between the parties, exchanged without prejudice and for the purpose of settlement.
