The applicant seeks permission to re-open the PTA refusal by Popplewell LJ.
The claimant company was run by volunteers to recycle furniture and other domestic items. One of the volunteers was the first defendant. It was alleged that he and another director arranged a self-invested personal pension for themselves funded in part by the transfer of the freehold of the property to SIPP providers. The company claimed that the transfer of the property amounted to a breach of their duties as directors and sought the return of the property or consequential relief.
