‘In relation to Birmingham City Council v James Maguire Junior D02BM967 on 12th September 2019, at Birmingham County Court I, Mr Recorder AD Smith QC, sentenced James Maguire Junior, to an immediate custodial sentence of 30 weeks’ imprisonment for contempt of court. The sentence was comprised of my activating a suspended sentence of 15 weeks’ imprisonment imposed on 20th August 2019 and imposing a consecutive sentence of 15 weeks’ imprisonment for a more recent breach. The basis of that sentence was that Mr Maguire repeatedly breached the same term of an injunction in a deliberate manner. There have been previous breaches of the same order and Mr Maguire committed the most recent breach very shortly after a suspended sentence of imprisonment had been imposed upon him. There was very significant culpability on his part for the persistent breaches but low harm. I consider that an immediate custodial sentence has the greatest likelihood of securing future compliance with the continuing order.’
