|Contempt of Court

Pursuant to paragraph 13 of Practice Direction: Committal for Contempt of Court – Open Court

In the County Court sitting at Burnley on 20 September 2019

In the matter of Together Housing Association Limited -v- Colette Walsh and another

Case number F00ZP667

District Judge Clarke sentenced Colette Walsh to a suspended committal order for contempt of court. The basis of that sentence was that Colette Walsh admitted breaching an order made by the court on 9 July 2019 pursuant to Section 1 of the Anti-Social Behaviour, Crime and Policing Act 2014. The breaches admitted and sentences imposed were as follows:

  1. Entering 1 Silverdale Close, Blackburn on 28 August 2019, in breach of paragraph 1(1) of the injunction order – a sentence of 28 days was imposed.
  2. Entering 1 Silverdale Close, Blackburn on 10 September 2019, in breach of paragraph 1(1) of the injunction order – a sentence of 28 days was imposed.

The court directed that the sentences should run concurrently. Accordingly it was ordered that Colette Walsh be committed for contempt to prison for a total period of 28 days. The order is suspended until 30 November 2020 and will not be put into force if during that time Colette Walsh complies with the terms of the injunction order made on 9 July 2019.
