Case Number – E90NE044 : Northumberland County Council -v- Scott, Scott & Whalen
In relation to the above numbered case on 6th August 2019, Her Honour Judge Moir sitting as a Judge of the High Court at Newcastle District Registry (sitting at Newcastle Combined Court Centre), sentenced the Defendant Kelly Whalen to a custodial sentence of 28 days (and activated a suspended sentence of 28 days imposed on 22nd July 2019 to run concurrently with the present sentence) for contempt of court on breach of an injunction order dated 5th October 2018.
Kelly Whalen was in breach of the injunction, by:
- Attending at Delaval Terrace on 22nd July 2019 at 11:00am and being passed an envelope containing £40.
- Attending at Delaval Terrace on 22nd July 2019 at 11:30am and being passed an envelope containing £20 in cash.
- At 7:00pm on 22nd July 2019 attending Delaval Terrace and being handed an envelope containing £20 in cash.
These breaches were contrary to the terms of the injunction order dated 5th October 2018 whereby the Third Defendant was forbidden to have any contact with the First Defendant, and the Third Defendant was forbidden to enter Delaval Terrace, Blyth, Northumberland.
