Pursuant to paragraph 13 of Practice Direction: Committal for Contempt of Court – Open Court

A00BR412 Affinity Sutton -v- Martin

In relation to the above numbered case on 27 August 2015, whilst sitting at the County Court at Bromley as a District Judge of the County Court of Bromley, I sentence the Defendant in that case, Mr David Martin be committed for contempt to prison for a (total) period of two months.  The Order is suspended until 4:00 pm on the 27 August 2017 and will not be put in force if during that time the contemnor David Martin complies with the Injunction Order dated 27 August 2015.

The basis of the sentence was that Mr David Martin disobeyed the Order dated the 10 March 2014 by causing nuisance and noise to the occupier of 12 Ottershaw House by tapping on the walls and banging on the ceiling. Mr David Martin also used abusive, insulting and threatening words or behaviour towards another person with a right to occupy housing accommodation in the neighbourhood of Ottershaw House.
