Pursuant to paragraph 13 of Practice Direction: Committal for Contempt of Court – Open Court

In relation to the above numbered case on Friday 20 January 2017 Mr Justice Holroyde sitting in the High Court at Birmingham as a Judge of the High Court, sentenced the First Defendant, Mr. Sam Stuart Green, in that case, to detention for a period of 4 months, (concurrently in respect of each breach) for contempt of court on breach of an Injunction Order dated 1 December 2014. The committal order is suspended until 1 February 2018.
The basis of the sentence imposed is that Mr. Sam Stuart Green:
Was in breach of the Injunction dated 1 December 2014, by
(1) On Monday 8th August 2016 at 11.45 pm you were the driver of a white Corsa registration number Vi 9 SSG (“the Corsa”) and for the alleged reasons particularised at paragraphs 16.2 to 16.15 Below, you participated in a car cruise near Flood Street car park, Dudley, West Midlands, contrary to clause 1 of an injunction granted by the Birmingham District Registry of the High Court of Justice on December 2014 (“the Injunction”).
(2) The Corsa, driven by you at all material times, was in a moving convoy of approximately 9 vehicles on the public road adjacent to Flood Street car park, known as Mill Street, Dudley. It is alleged that the Corsa and 2 other vehicles then turned off towards Flood Street towards Duncan Edwards Way.
These breaches were contrary to the terms of the Injunction Order dated 1 December 2014 to which Mr. Sam Stuart Green is subject.
