Richard Hicken v Clive Malcolm Ellison  EWHC 2791
On 8 November 2016, I handed down judgment in an application by Richard Hicken for the committal of Clive Malcolm Ellison to prison for contempt of court. In that judgment, I found Dr Ellison guilty of contempt on a number of counts. I postponed sentencing to a further hearing, which I held today, 1 December 2016. I now write to provide the details required by the relevant Practice Direction as follows:
Pursuant to paragraph 13 of the Practice Direction: Committal for Contempt of Court – Open Court
In relation to Case Nos 3873 of 2000 and 359 of 2012 on 1 December 2016 at the Royal Courts of Justice, Strand, London, I, Mr Justice Warren, sentenced Clive Malcolm Ellison to an immediate custodial sentence of 9 months for contempt of court. The basis of that sentence was that Dr Ellison had failed to comply with disclosure orders made successively by Registrar Derrett, Mr Justice Henry Carr and Mr Justice Mann in that (i) he failed to provide proper disclosure at all and (ii) failed to swear any affidavit verifying the accuracy and adequacy of the disclosure which he did give.
The Neutral Citation Number of my judgment finding him guilty of contempt is  EWHC 2791 (Ch). A transcript of my oral judgment at today’s sentencing hearing will be produced in due course.
