General Dynamics UK Ltd –v- The State of Libya

The Claimant appeals with permission from Males LJ paragraphs 1, 2 and 6 of his order dated 18 January 2019 sitting in the Commercial Court in the matter of an Arbitration, setting aside paragraphs of Teare J’s order dated 20 July 2018 concerned with service. Teare J’s order dispensed with service of the order for enforcement.

The claimant is a United Kingdom company which is part of the General Dynamics group, a global military defence conglomerate. The award which it seeks to enforce was made on 5 January 2016 by an ICC arbitral tribunal in Geneva. The dispute related to a contract between the parties for the supply of communications systems. The tribunal awarded £16,114,120.62 in favour of the claimant, together with interest and costs.
