The Defendant appeals the order of Mr David Stone dated 9 April 2020, sitting as a Deputy High Court Judge in the Patents Court, by which he held that European Patent (UK) 2 430 238 (the Patent) was valid and infringed. Permission to appeal was refused.

The Claimant, Geofabrics Limited, sued the Defendant, Fiberweb Geosynthetics Limited, for infringement of the Patent titled ‘trackbed liner and related methods’ seeking injunctions, an inquiry as to damages or an account of profits, and other remedies. The infringing product was said to be the Defendant’s Hydrotex 2.0, a trackbed liner used by Network Rail in the laying of railway tracks in the United Kingdom. By his order of 9 April 2020 Mr David Stone found for the Claimant.
