Gul –v- McDonagh & anr

The Claimant (C) appeals the order of HHJ Mark Gargan dated 8 January 2021, sitting as a Deputy High Court Judge, whereby he ordered C can recover 90% of any damages he may be awarded.
The Judge found C was 10% contributorily negligent in respect of a road traffic accident which occurred on 17 October 2015 when C was aged 13, crossing a road. The grounds say the First Defendant was driving at 45 mph on a residential road fleeing from the police. The Second Defendant is the Motor Insurers Bureau.
