Ideal Shopping Direct Ltd & others (claimant/appellant) v VISA Europe Ltd & others (defendants)

The Claimants, Ideal Shopping Direct and others, appeal, with the permission of Morgan J, his order of 16 December 2020, whereby he ordered that the Claimants have not effected valid service of the proceedings on the Defendants, that the Court has no jurisdiction to hear the proceedings, that the Claimant’s application to the effect that the unsealed, amended claim forms were validly served be dismissed and made associated costs orders. There are 199 Claimants/Appellants across a number of consolidated proceedings.

The claims made in these 16 cases were for breaches of competition law said to have been committed by Visa and Mastercard. The claim forms fell into two groups. One group alleged infringements of Article 101 and Article 102 of the Treaty on the Functioning of the European Union (TFEU) or the comparable provisions in Articles 53 and 54 of the Agreement on the European Economic Area (the EEA) or in Chapter I and Chapter II of the Competition Act 1998. A second group of claims alleged only infringements of Article 101 of TFEU, Article 53 of the Agreement on the EEA and Chapter I of the Competition Act 1998.
