The Appellants/Claimants appeal against the order made by Stuart-Smith J (as he then was) dated 14/8/20 directing that the Bonga community and the two named Claimants do not have the same interest in the claim for the purposes of establishing a representative action under CPR 19.6(1).
The judge ordered that the claims brought on behalf of the Bonga community by the named Claimants be struck out, leaving only the personal claims of the named Claimants.
