The Defendant below seeks to challenge the order of Mr Justice Fordham dated 16 September 2021, by which he allowed the Claimant’s claim for judicial review, made a declaration that the Defendant must implement the advice of Public Health England and ordered costs for the Claimant.

Factual Background:  This claim concerns the emissions of Hydrogen Sulphide from Walleys Quarry landfill site in 2021 and the effect on the health and well-being of the Claimant, a 5 year old boy with particular medical vulnerabilities. The Defendant asserts that the complaint was that the action taken by the Defendant had not yet resulted in the emissions problem being resolved, rather than one of inaction by the Defendant.
