Rotala plc (claimant/appellant) v Greater Manchester Combined Authority & ors (defendants/respondents)

By Appellant’s Notice filed on 18 March 202, Rotata plc appeal the Order of Knowles J dated 9 March 2022, by which the Rotata’s claim for judicial review was dismissed.

Facts: Stagecoach Manchester is a major commercial bus operator whose business is largely focused on South Manchester. Rotala also operates bus and coach services in the North-West, and is the second largest bus operator in the Greater Manchester area. The underlying JR is against the Defendants/Respondents decisions taken on 27th November 2020 (by the First Respondent only) and 25th March 2021 (by both Respondents) to respectively (a) recommence a consultation process and (b) recommend and make a proposed Franchising Scheme in respect of the operation of bus services in Greater Manchester pursuant to Sections 123A-G of the Transport Act 2000 (as amended). The Appellant’s case is that both decisions were unlawful.
