The Claimant appeals against the order made by O’Farrell J dated 15/4/21 following a handed down judgment of 19/2/21.
The judge held that D had repudiated the contract between the parties but dismissed C’s claim to recover the expenditure it wasted by reason of that repudiation which it quantified at 128 Million pounds on the basis that wasted expenditure was excluded by an exclusion of loss of profit, revenue or savings in clause 23.3 of the Master Services Agreement between the parties.
