The Electronic Collar Manufacturers Association & anr –v- The Secretary of State for the Environment, Food and Rural Affairs

20th April 2021

Appeal against the Order of Morris J (24 October 2019) that dismissed the application for judicial review.

The Appellants seek to challenge the decision of the Secretary of State to ban the use of hand-held remote-controlled e-collar devices for cats and dogs. The position taken was to introduce regulations under the provisions of section 12 of the Animal Welfare Act 2006. The Appellants criticise the consultation process and contend that there is a less restrictive means of promoting animal welfare by the regulation of the use of e-collars, rather than prohibition.
