The appellants, who were Seventh and Eights Defendants in the court below, appeal in respect of the order Mr Justice Andrew Baker, sitting as High Court Judge, dated 18 December 2020, by which he dismissed their application for summary judgment for the reasons set out in a judgment of the same date [2020] EWHC 3501 (Comm) and ordered the Seventh and Eighth Defendants to pay the Claimants’ (Vale SA and Vale International SA) costs of the application and the directions application, summarily assessed in the amount of £113,310.93 agreed between the parties, by 15 January 2021.
The appellants seek an order that the application for summary judgement is granted, and that the Claimants’ proprietary claims set out in paragraphs 118-120 of the Particulars of Claim are dismissed.
