A full list of court fees can be found in the Ministry of Justice’s EX50 (PDF) and EX50A (PDF). HM Courts & Tribunals Service has also provided a guidance note EX50 (PDF) explaining a subset of the fees applicable in civil claims, including Commercial Court matters.

How do I calculate the appropriate fee for the claim I intend to bring?

When seeking financial relief, the fee payable is likely to depend on the value of your claim. Please see EX50A (PDF) for details of the relevant fee for claims of various monetary values.

The fee may further be affected by whether the relief sought in the claim is monetary or of a non-monetary nature, and whether these remedies are sought concurrently or in the alternative.

I am a defendant – do I have to pay to defend the claim against me?

Whilst there is no charge for filing a defence or acknowledgment of service in the Commercial Court, please be aware that bringing a counterclaim incurs the same fee as if the claim had been filed independently (i.e. as a freestanding claim in a claim form).

I have calculated the applicable fee for my filing, but the CE-file system provides a different figure by default. How do I make sure the correct fee is paid and my filing accepted?

If the e-filing system calculates the applicable fee incorrectly by default, please contact the Issue section of the Listing Office after filing to arrange payment of the balance (comct.issue1@justice.gov.uk).

Filing

The Electronic Working Scheme (CE-File) operates in the Commercial Court, full details of which can be found at Practice Direction 51O. This means that many documents in the Commercial Court must now be provided or filed electronically (e-filing) using CE-File. Find out more information on e-filing.

Forms

There are various practice forms which are used or have been adapted for use in the Commercial Court. Practice Direction 58 and the Commercial Court Guide (PDF) provide further direction concerning specifically which practice form should be used at each stage of proceedings.

The forms listed above must be used by parties when litigating in the Commercial Court. Variations of these forms apply to London Circuit Commercial Court claims, Regional Circuit Commercial Court claims and claims brought under the Financial List. A full list of these forms can be found on GOV.UK.
