Technology & Construction Court Guide revision for applications or claims under the Building Safety Act 2022
Building Safety Act Working Group update – 20 June 2025
The Building Safety Act Working Group (the “BSA Working Group”) has considered whether amendments to the Technology and Construction Court Guide (October 2022) (the “TCC Guide”) are appropriate to address practical issues where proceedings rely upon Part V of the Building Safety Act 2022 (“BSA”).
The BSA Working Group’s paper proposing amendments to the TCC Guide has been submitted to the TCC Working Group updating the TCC Guide.
In summary, amendments have been proposed to the TCC Guide to:
- Include reference to BSA related claims in the definition of ‘TCC Claims’ to which the TCC Guide relates;
- Clarify the application of the Pre-Action Protocol for Construction and Engineering Disputes to BSA related claims prior to commencement of the proceedings in the Technology and Construction Court (“TCC”);
- Set out the TCC’s position on the expected use of ADR before and during proceedings for BSA related claims;
- Provide guidance on procedural issues which may arise where proceedings involve the BSA; and
- Provide for a streamlined resolution process in respect of a dispute in which parties may be seeking different orders under the BSA which ostensibly span the jurisdiction of both the First Tier Tribunal (Property Chamber) (“FTT”) and the TCC.
The proposed revisions will be incorporated into the TCC Guide.
