Anonymity Order

PENAL NOTICE

If you, B, (the “Respondent”), disobey this Order you may be held to be in contempt of court and may be imprisoned, fined or have your assets seized.
Any other person who knows of this order and does anything which helps or permits the Respondent to breach the terms of this Order may also be held to be in contempt of court and may be imprisoned, fined or have their assets seized.

THIS ORDER

  1. This is an Injunction made against the Respondent on 10 August 2023 by Mr Justice Lane on the application of A (the “Application” and the “Applicant” respectively). The Judge read the evidence listed in Schedule 1 and accepted the undertakings set out in Schedule 2 at the end of this Order.

    ANONYMISATION
  2. The Court considers that it is necessary pursuant to CPR 39.2(4) that the identities of the parties shall not be disclosed. The Applicant shall be referred to as “A” and the Respondent shall be referred to as “B”.
  3. A copy of this Order shall be published on the website of the Judiciary of England and Wales.
  4. Any person who is not a party to the proceedings may apply to set aside or vary paragraph 2 of this Order provided that notice of such application shall be given to the parties.

ACCESS TO DOCUMENTS

  1. No copies of the Application, the witness statements and the statements of case will be provided to a non-party without further order of the Court.
  2. Any non-party other than a person notified or served with this Order seeking access to, or copies of the above-mentioned documents, or any other document filed by a party or communication between the Court and a party, must make an application to the Court, proper notice of which must be given to the other parties.

INJUNCTION

  1. Until further order of the Court, the Respondent must not use, publish or communicate or disclose to any other person in any form or by any means (other than (i) by way of disclosure to legal advisers instructed in relation to these proceedings for the purpose of obtaining legal advice in relation to these proceedings or (ii) for the purpose of carrying this Order into effect) all of any of the information referred to in Schedule 3 to this Order (the “Information”).

EXTENSION OF WITHOUT NOTICE INJUNCTION

  1. The Order of Mr Justice Murray in these proceedings dated 27 July 2023, is extended until 7pm on 11 August 2023.

COSTS

  1. The Respondent shall pay the Applicant’s costs of the Application, to be assessed if not agreed.
