UPON the application of the Financial Conduct Authority (“the Applicant”) for an order pursuant to CPR 39.2 that the hearing of the Applicant’s application for an order pursuant to section 380(3) of the Financial Services and Market Act 2000 should be heard in private
UPON HEARING Counsel for the Applicant
AND UPON THE COURT being satisfied pursuant to CPR 39.2(3) that that it is necessary to sit in private for the hearing to secure the proper administration of justice and that publicity would defeat the object of the hearing in the event that the court did not approve the proposed order.
IT IS ORDERED THAT:
(1) Pursuant to CPR 39.2(5) a copy of this order shall be published on the website of the Judiciary of England and Wales (which may be found at www.judiciary.uk). Any person who is not a party to the proceedings may apply on notice to all the parties to attend the hearing and make submissions, or to vary or set aside this order.
(2) This Order will be served by the Applicant’s legal representatives on the Respondents.
