ORDER by the Honourable Mr Justice Holgate
- The Claimant is granted anonymity and shall be referred to as A1 (Afghanistan).
- The time limits in CPR 54.8 for (a) the filing by the Defendant of an Acknowledgment of Service and any Summary Grounds of Defence and (b) the service of that document on the Claimant, are abridged so as to expire at 4pm on 8 February 2024.
- The application for permission to apply for judicial review shall be determined by a judge on the papers by no later than 15 February 2024.
- No order for costs.
Reasons
- In accordance with In Re an Application for Judicial Review [2021] 1 WLR 6121 the claimant has justified the abridgment of time sought and the need for urgent consideration of the application for permission. I understand from the certificate of service that the Defendant was served with the claim on 25 January 2024.
- By this order I am allowing ample time for the Defendant to respond on this urgent matter. On the face of it, the muddle and delay in the proper determination by the Defendant of the Claimant’s application is not justified.
