Order

UPON the Defendant, on 2 May 2023, dismissing the Claimant’s appeal (the ‘Appeal Decision’)
AND UPON the Claimant’s application for permission to seek judicial review of the Appeal Decision
AND UPON the parties having agreed the below

BY CONSENT IT IS ORDERED that:
(1) The Appeal Decision be quashed.
(2) Subject to paragraph (3), the Interested Party, via a third party, shall, as soon as reasonably practicable and in any event by 20 September 2023 (the “Longstop Date”), arrange for a new independent appeal panel (“IAP”) to be constituted and a new hearing of the Claimant’s appeal to take place.
(3) If necessary (acting reasonably), on one occasion the Interested Party may vary the Longstop Date. If the Interested Party needs to vary the Longstop Date, as soon as reasonably practicable following it becoming clear that the Longstop Date needs to be varied, the Interested Party must correspond with the Claimant to arrange a new mutually convenient date for the IAP hearing. Once the new date for the IAP hearing has been agreed, this would replace the Longstop Date stipulated at paragraph 2 of this Consent Order. Any relisted hearing shall, subject to the Claimant’s availability, be arranged to take place within a reasonable timeframe and in any event by no later than 7 days of 20 September 2023.
(4) The appropriate order as to costs between the parties shall be determined by the Court on the papers following written submissions filed and served by the parties by 4pm on 22 September 2023.
(5) There be substituted for all purposes in these proceedings in place of reference (whether orally or in writing) to the Claimant by name, reference to the letters ‘AB’.
(6) There be substituted for all purposes in these proceedings in place of reference (whether orally or in writing) to the Defendant by name, reference to ‘Panel’.
(7) There be substituted for all purposes in these proceedings in place of reference (whether orally or in writing) to the Interested Party by name, reference to ‘an Academy’.
(8) Until further order, the publication in connection with these proceedings of the name of the Claimant, or her daughter or any other members of her family or of any information liable to lead to their identification in connection with these proceedings be prohibited.
(9) Until further order, the publication in connection with these proceedings of the name of the Defendant, or of any information liable to lead to the Defendant’s identification in connection with these proceedings be prohibited.
(10) Until further order, the publication in connection with these proceedings of the name of the Interested Party, or of any information liable to lead to the Interested Party’s identification in connection with these proceedings be prohibited.
