UPON the parties having agreed the terms set out in the confidential schedule to this Order, copies of which are held by the parties’ solicitors,
AND UPON the parties agreeing that it is necessary that the Claimant be anonymised, the Court file be sealed, and reporting restrictions be imposed, in order to protect the Claimant’s Article 8 ECHR rights, including his right to privacy,
BY CONSENT IT IS ORDERED THAT:
- This claim is stayed to give effect to the terms attached to the confidential schedule annexed hereto.
- The Claimant be anonymised so that the initials “ABC” are substituted for the name of Claimant for all purposes in these proceedings;
- Pursuant to section 11 of the Contempt of Court Act 1981, nothing may be published which may directly or indirectly lead to the identification of the Claimant as having been a party to these proceedings, or to his location becoming known;
- The Court file be sealed. No document from the Court file may be disclosed to any third party without permission of the Court.
- The Defendant shall pay the Claimant’s costs of and incidental to these proceedings (which, for the avoidance of doubt, include judicial review claim number CO/3795/2021), on the standard basis to be assessed if not agreed.
- Pursuant to CPR 44.2(8) the Defendant shall pay 50% of the Claimant’s costs within 28 days of service of a bill of costs.
- There shall be a detailed assessment of the Claimant’s publicly funded costs.
