Order

On applications by the parties

Following consideration of the documents lodged by the Claimant, the Defendant and the Interested Party

ORDER by Timothy Corner KC sitting as a Deputy High Court Judge

1. Pursuant to CPR 39.2 the identity of the Claimant shall not be disclosed. The claim shall be referred to and listed as R (ABD) v Secretary of State for the Home Department.

2. The Claimant has permission to rely on the Amended Permission Bundle, including the Detailed Amended Statement of Facts and Grounds, lodged on 10 May 2024, which replaces the Claimant’s Protective Permission Bundle lodged on 30 April 2024.

3. The Defendant is granted an extension of time for service of Acknowledgement of Service until 21 days after the date on which this Order is sealed.

4. The Interested Party is removed as a party to the claim.

5. Costs reserved.

Reasons

1. The Defendant does not object to permission being given to the Claimant to rely on the Amended Permission bundle. In those circumstances it is appropriate for the Defendant to have the further extension of time requested.

2. My understanding (though I have not seen the letter) is that the Interested Party has asked to be removed as a party. Having examined the papers, I see no reason for the Interested Party to be joined as a party.
