AND UPON the court considering the Appellant’s application dated 12 September 2025 to set aside the Order of HHJ Bloom dated 9 September 2025
AND UPON the court noting that the parties wish to refer to judicial review proceedings in the High Court which are highly relevant background to these proceedings and which are themselves subject to an anonymity order made by Steyn J dated 26 November 2024 in the judicial review proceedings (Claim AC-2024-LON-003708), and that an anonymity order in this Appeal proceedings is necessary in order to allow the parties to make submissions in this Appeal whilst complying with the anonymity order in the judicial review proceedings
AND UPON the court considering the Appellant’s application for anonymity pursuant to CPR39.2(4), and being satisfied that non-disclosure of the Appellant’s identity is necessary to protect her interests and the Appellant and Respondent are bound by the Order made of Steyn J dated 26 November 2024 in AC-2024-LON-003708
AND UPON the court noting for completeness that the Appellant no longer pursues the application dated 7 May 2025 for permission to adduce witness evidence including her witness statement dated 9 November 2024 at the hearing of the Appeal, because this statement forms part of the housing file which has been disclosed pursuant to §3 of the Order of HHJ Saunders dated 27 May 2025

IT IS ORDERED THAT

  1. The Appellant’s application dated 12 September 2025 is allowed and the Order of HHJ Bloom dated 9 September 2025 is set aside.
  2. The Appellant’s application dated 7 May 2025 is allowed.
  3. The Appellant shall be afforded anonymity and shall be referred to as “AC”. There shall not be disclosed in any report of the proceedings the name or address of the Appellant or her children or any detail likely to lead to the identification of the Appellant or her children.
  4. Pursuant to CPR 5.4C a person who is not a party to the proceedings may obtain a copy of a statement of case, judgment or order from the court records only if the statement of case, judgment or order has been anonymised such that (a) the Appellant is referred to in those documents only as AC; and (b) any identifying reference to the Appellant and her children has been deleted from those documents.
  5. The parties must:
    a. when filing a statement of case or skeleton argument; or
    b. in respect of a statement of case or skeleton argument filed prior to this Order, within seven days of this Order; also file a redacted copy of that statement of case or skeleton argument omitting the name, address and any other information which could lead to the identification of the Appellant.
  6. The matter shall be listed as “AC v. London Borough of Haringey”.
  7. Any person, including members of the press, may apply to the court to vary or discharge this Order on seven days’ notice to the parties.
  8. This Order shall be published on the website of the Judiciary of England and Wales pursuant to CPR r.39.2(5).
  9. Costs in the Appeal.
