Secretary of State for the Home Department

Order

UPON reading the documents lodged by the Claimant including the Application for Urgent Consideration

AND UPON the Claimant seeking an order that the Defendant provide the Claimant with accommodation in Manchester, in accordance with s.98 IAA 1999, and an order for anonymity

ORDER BY THE HON. MR JUSTICE SAINI

(1) The Defendant shall provide the Claimant with accommodation in Manchester with immediate effect and by no later than 19.00 hours on 30 September 2025.
(2) The Claimant shall be anonymised and a litigation friend ODEY HUSSAIN shall be
appointed.
(3) Any application to vary or discharge this Order to be made on 24 hours notice.
(4) Costs reserved.

REASONS

I am satisfied that on American Cyanamid principles there is a serious issue to be tried and the balance of convenience justifies urgent interim relief. The Claimant’s disability and communication plainly need require accommodation in Manchester and he is at real risk of destitution. I will also make orders for anonymity and appointment of an litigation friend, as requested. I have provided for provision of accommodation by a time which is realistic given the time at which this application has been considered by me.

Signed: MR JUSTICE SAINI
