Order
On an application by the Claimant for urgent consideration and interim relief
Following consideration of the documents lodged by the Claimant
ORDER by the Hon. Mr Justice Chamberlain:
- Anonymity:
(a) Pursuant to CPR 39.2(4) and the Court’s inherent jurisdiction and pursuant to s. 6 of the Human Rights Act 1998:
(i) the names of the Claimant and Interested Parties are to be withheld from the public and must not be disclosed in any proceedings in public; and
(ii) the Claimant is to be referred to orally and in writing as “AGT”; and the First and Second Interested Parties are to be referred to orally and in writing as “AAP” and “AXP” respectively.
(b) Pursuant to s. 11 of the Contempt of Court Act 1981, there must be no publication of the identity of the Claimant or Interested Parties of any matter likely to lead to the identification of the Claimant or Interested Parties in any report of, or otherwise in connection with, these proceedings.
(c) Any person wishing to vary or discharge this Order must make an application, served on each party.
- Directions for consideration of interim relief:
(a) The Defendant may respond in writing to the application for interim relief by 4pm on Monday 13 January 2025.
(b) The Claimant may reply in writing by 4pm on Wednesday 15 January 2025.
(c) The papers are to be referred to a judge or deputy judge for a decision on interim relief immediately thereafter.
REASONS
Anonymity: The Claimant is an asylum seeker. Although there is no application for anonymity, it appears likely that naming him or the Interested Parties would place them at risk on return to Russia.
Directions: The directions set out above strike the appropriate balance between allowing the Defendant a proper opportunity to respond and addressing the urgency of the situation, as disclosed by the Statement of Facts and Grounds.
