    Consent order

    FURTHER to the order of Upper Tribunal Elizabeth Cooke sitting as a Deputy Judge of the High Court on 3 July 2024 linking these matters together for final hearing,

    AND UPON the Defendant making an application on 30 July 2024 to seek an extension of time to file their detailed grounds of defence in IS (Bangladesh) (AC-2023-LON-003511) until 11 September 2024 which is yet to be considered by the Court,

    AND UPON the Claimant AH (AC-2024-LON-000816) making an application on 30 August 2024 to amend his grounds N461 claim form and statement of facts and grounds,

    AND UPON the Defendant confirming on 9 September 2024 that she concedes grounds 1, 2 and 4 in the claim IS (Bangladesh) (AC-2023-LON-003511),

    BY CONSENT IT IS ORDERED THAT:

    1. The Claimant AH (AC-2024-LON-000816) is granted permission to rely on his amended Statement of Facts and Grounds and amended N461 claim form dated 30 August 2024.
    2. The Claimant AH (AC-2024-LON-000816) is granted permission to rely on the second witness statement of Lewis Roach-Kett dated 30 August 2024 and accompanying exhibits bundle.
    3. The Claimant IS (Bangladesh) (AC-2023-LON-003511) is permitted to amend ground three of his detailed statement of facts and grounds (and in turn his N461 claim form) to reflect the amendments permitted in ground six of AH (AC-2024-LON-000816) as per paragraph 1 above. If IS (Bangladesh) chooses to do so, he must file these amendments to his detailed statement of facts and grounds by 4pm on 20 September 2024 or otherwise confirm to the Court that he does not intend to amend them.
    4. The Defendant shall file a joint amended defence addressing the amended statement of facts and grounds in AH (AC-2024-LON-000816) and ground 3 in IS (Bangladesh) (AC-2023-LON-003511) by 4pm on 27 September 2024. The Defendant shall file any further evidence, including (if not already provided) disclosure in IS (Bangladesh) in line with her duty of candour, by the same time and date.
    5. A separate order shall be agreed between IS (Bangladesh) (AC-2023-LON-003511) and the Defendant in relation to the terms on which grounds 1, 2 and 4 of that claim shall be disposed, within four weeks of signing this order, including on declarations and costs. Absent agreement, the terms of disposal be reserved for determination at trial.
    6. For all other matters related to this order, costs in the case.
