- Anonymity:
(a) Pursuant to CPR 39.2(4) and/or the Court’s inherent jurisdiction and/or s. 6 of the Human Rights Act 1998:
(i) the Claimants’ names are to be withheld from the public and must not be disclosed in any proceedings in public; and
(ii) the Claimants are to be referred to orally and in writing as “AH”, “BH” and “CH”.
(b) Pursuant to s. 11 of the Contempt of Court Act 1981, there must be no publication of the identity of the Claimants or of any matter likely to lead to the identification of the Claimants in any report of, or otherwise in connection with, these proceedings.
(c) Pursuant to CPR 5.4C(4):
(i) the Claimants must within 7 days file a redacted copy of any statement of case filed, omitting the name, address and any other information likely to lead to the identification of the Claimants;
(ii) if any statement of case subsequently filed includes information likely to lead to the identification of the Claimants, a redacted copy omitting that information must be filed at the same time;
(iii) unless the Court grants permission under CPR 5.4C(6), no non-party many obtain a copy of any unredacted statement of case.
(d) Any person wishing to vary or discharge this Order must make an application, served on each party.
- Abridgement of time and expedition:
(a) The Defendant’s Acknowledgement of Service) must be filed and served by 4pm on 16 April 2025.
(b) Any Reply from the Claimant must be filed and served by 4pm on 25 April 2025.
(c) The papers are to be referred to a judge or deputy judge within 7 days thereafter.
REASONS
(1) Anonymity: The Claimants have not made an application for anonymity. However, I note that the First Claimant is an asylum seeker. The Second and Third Claimants are her children. There are accordingly compelling reasons for the limited derogations from the principle of open justice in paragraph 1.
(2) Abridgement of time/expedition
The Claimants seek an order for permission to be considered within two weeks or alternatively, if permission is granted on the papers, an order that the matter is suitable for an expedited substantive hearing with a time estimate of 1 day. The Claimants have not set out a specific timetable for any abridged time for the Defendant to file its Acknowledgement of Service. The basis for the request is an attack by the Claimant’s ex-partner on 7 February 2025.
(3) The Defendant’s Acknowledgement of Service would be due on 16 April 2025 unless abridgement was ordered. Having regard to the points raised by the Defendant in its email of 3 April 2025 and the fact that the Acknowledgement of Service is due next week, I do not consider that abridgement is necessary. Nonetheless, I accept that a degree of expedition for consideration of permission is appropriate, albeit not the degree which the Claimants have sought. I have therefore directed that the application for permission should be considered within 7 days of the filing of any Reply to the Defendant’s Acknowledgment of Service.
