Order

UPON the Claimant’s application for judicial review of the Defendant’s ongoing failure disperse her to suitable accommodation under s95 of the Immigration and Asylum Act 1999 (IAA)
AND UPON the Claimant being granted an Order of Mrs Justice Yip dated 9 February 2023 requiring the Defendant to file an Acknowledgement of Service within an abridged timeframe
AND UPON the Defendant conceding the claim and agreeing to disperse the Claimant to s95 IAA accommodation within London on 23 February 2023
AND UPON non-disclosure of the identity of the Claimant being necessary in order to protect the interest of the Claimant, pursuant to rule 39.2(4) of the Civil Procedure Rules
AND UPON the parties having agreed to compromise the substantive judicial review claim
BY CONSENT IT IS ORDERED THAT:-

  1. The Claimant withdraws the claim no CO/531/2023
  2. The Claimant’s claim shall be anonymised and shall be referred to in these proceedings as AH.
  3. The Defendant shall pay the Claimant’s inter partes costs of the claim, to be assessed if not agreed.
  4. There shall be a detailed assessment of the Claimant’s publicly funded costs.
