UPON READING the Claimant’s Claim Form, Statement of Facts and Grounds, and N463 Application for Urgent Consideration

IT IS HEREBY ORDERED THAT:

1. Pursuant to rule 39.2 of the Civil Procedure Rules, the identity of the Claimant shall not be disclosed directly or indirectly and this matter shall be known and listed as R (AJ) v London Borough of Lewisham.

2. The application for expedition is granted. The Defendant shall file and serve its acknowledgement of service and summary grounds of resistance within 14 days of the date of this order. The applications for permission and interim relief shall be placed before a Judge as soon as possible thereafter.

3. Liberty to apply with at least 2 clear days’ notice to the other parties.

4. Costs reserved.

Reasons

The only dispute in relation to this order is whether the Defendant has 14 or 21 days to respond. In my view 14 days is sufficient given that there is some urgency to the matter, and 14 days will give the Defendant enough time to file Summary Grounds.
