  1. The Claimant’s and Interested Party’s identities are to be anonymised and they are to be referred to as AM and IM respectively. Their daughter’s identity is also to be anonymised and she is to be referred to as CM. No information can be published which may lead, directly or indirectly, to their identification. This is to protect the interests of CM, who has complex special needs.
  2. The Defendant is to provide a response to the application for interim relief and for permission to seek judicial review by 4pm on Friday 25 November 2022.
  3. The papers are to be placed before a judge for a decision on permission and interim relief as soon as reasonably practicable thereafter.
  4. Costs reserved.

Reasons

  1. The Claimant’s draft order proposes an unrealistic basket of orders by way of interim relief. I decline so to order. In the current financial climate, councils have many demands on their resources. The Defendant must have an opportunity to respond in a considered way to the claim. Given the delays, they must do so quickly. It will then be considered by a judge speedily thereafter.
