BEFORE HER HONOUR JUDGE KELLY sitting at the Birmingham District Registry, Civil Justice Centre, The Priory Courts, Bull Street, Birmingham, B4 6DS on 14 July 2021

UPON hearing Leading Counsel for the Claimant and Counsel for the Defendants on a remote video hearing conducted on the HMCTS video platform

WHEREAS the Claimant has made a claim (‘the Claim’) against the Defendants for personal injuries suffered in of a road traffic collision on 20 May 2016 and in respect of which proceedings were commenced by the Claimant in the High Court of Justice by proceedings issued on 10 November 2020

AND WHEREAS the Claimant is a protected party and brings the Claim by her Husband and Litigation Friend

AND UPON the Court being satisfied that an anonymity Order is necessary

IT IS ORDERED that:

  1. The Claimant shall hereinafter be referred to in these proceedings as DMD and the Litigation Friend as SD.
  2. Pursuant to CPR Rule 39.2(4) there shall not be disclosed in any report of the proceedings the name or address of the Claimant or any details leading to the identification of the Claimant, and the Claimant, if referred to, shall only be referred to as DMD.
  3. Pursuant to CPR Rule 39.2(4) there shall not be disclosed in any report of the proceedings the name or address of the Litigation Friend or any details leading to the identification of the Litigation Friend, and the Litigation Friend, if referred to, shall only be referred to as SD.
  4. Pursuant to CPR rule 5.4C a person who is not a party to the proceedings may obtain a copy of a statement of a case, judgment or order from the court records only if the statement of case, judgment or order has been anonymised such that: (a) the Claimant is referred to in those documents as DMD, (b) the Litigation Friend is referred to in these documents as SD and (b) the address of the Claimant and Litigation Friend is deleted from those documents.
