Order

UPON the Court’s reserved judgment being handed down remotely on 7 February 2025:

AND UPON the Claimant having indicated an intention to seek permission to appeal;

AND UPON the Court accordingly adjourning the notional “hearing” at which hand-down took place so as to preserve jurisdiction to consider any application for permission to appeal

AND UPON having considered the parties’ draft orders

IT IS ORDERED that:

1. The claim is dismissed.

2.  The parties shall file and serve costs submissions, limited to 4 sides of A4, no less than 1.5 spaced, by 4pm on 14 February 2025.

3. The Court shall determine costs thereafter without a hearing.

4. Time for seeking permission to appeal from this Court is extended until 7 days after the Court makes its order for costs. Any such application shall be determined without a hearing.

5. Time for seeking permission to appeal from the Court of Appeal is extended to 21 days after the Court makes its order for costs or, in the event that a party makes a timely application to this Court for permission to appeal, 21 days after the Court determines that application.

    Brief Reasons

    1. The parties proposed different provisions for submissions on costs. Sequential submissions and replies are not justified in this case and will cause unnecessary delay. Each party will be aware of – or can establish – their opponent’s stance on costs. Brief simultaneous submissions will suffice.
