Following consideration of the documents lodged by the Claimant and a draft consent order
ORDER BY THE HON. MR JUSTICE CALVER
- Anonymity:
(a) Pursuant to CPR 39.2(4) and/or the Court’s inherent jurisdiction and/or s. 6 of the Human Rights Act 1998:
(i) the Claimant’s name and the Defendant’s name is to be withheld from the public and must not be disclosed in any proceedings in public; and
(ii) the Claimant is to be referred to orally and in writing as APF.
(iii) The Respondent is to be referred to orally and in writing as “Chief Constable of X Constabulary”.
(b) Pursuant to s. 11 of the Contempt of Court Act 1981, there must be no publication of the identity of the Claimant or Respondent or of any matter likely to lead to the identification of either of them in any report of, or otherwise in
connection with, these proceedings.
(c) There be no public access to the Court file save for a version of the Statement of Facts and Grounds that excludes the Confidential Annex.
(d) Any person wishing to vary or discharge this Order must make an application, served on each party. - Stay
(a) The claim shall be stayed until 35 days after the outcome of the Claimant’s appeal to the Security Vetting Appeals Panel is notified to the parties.
(b) The Claimant has permission to file an amended Claim Form, Statement of Facts and Grounds and any supporting evidence within 14 days of the expiry of the stay.
(c) The Defendant shall file its Acknowledgment of Service within 21 days of service of the amended Claim Form or the Claimant’s notification that it does not intend to file an amended Claim Form. - Costs
