NOTIFICATION of the Judge’s decision
UPON consideration of the application for anonymity and expedition and the documents lodged by the claimant and the second to eighth interested parties
AND UPON there being no response by the defendant to the application be defendant
AND upon being satisfied that it is necessary to grant the application
ORDER by The Hon Sir Peter Lane
1. Until further order and pursuant to CPR 39.2(4), the identity of the claimant shall not be disclosed; and the claimant is to be referred to in these proceedings as “AR”.
2. The family members of the claimant are added as interested parties and shall be referred to as “Y1”, “Y2”, “Y3”, “Y4”, “Y5”, “Y6” and “Y7”.
3. The claim is fit for expedition.
4. The defendant shall file and serve an acknowledgment of service not later than 24 July 2024.
5. Any reply shall be filed and served not later than 7 days after service of the acknowledgment of service on the claimant.
6. The papers will be put before a judge for decision as soon as possible after 1 August 2024.
7. Liberty to apply.
8. Costs reserved.
Observations
1. Given the subject matter, it is plainly appropriate to grant anonymity to the claimant and the claimant’s family; likewise, expedition.
2. As it appears service of the claim occurred on 24 June 2024, service of the acknowledgment of service is in any event due. Nevertheless, to give certainty to the subsequent steps of the process, I have provided for service of the AoS to be effected by 24 July.
