UPON considering the N461 and N463 dated 8 May 2025, the Claimants’ detailed statement of facts and grounds of 8 May 2025, and the attached certificate of suitability

AND UPON considering the Claimants application notice dated 26 June 2025

AND UPON

(1) Consideration of the Article 8 rights of the Claimants and their family in the UK to respect for private and family life, and the Article 10 right to freedom of expression.
(2) The court being satisfied that a derogation from open justice is necessary to secure the proper administration of justice and in order to protect the interests of Claimants and their family in the UK and that there is no sufficient countervailing public interest in disclosure.
(3) There being (at this stage) no representations from the press or any other interested party.

IT IS ORDERED THAT:

Stay

  1. If this claim has otherwise been stayed, the stay shall be lifted.

    Anonymity and reporting restrictions
  2. The identity of the Claimants as parties to these proceedings shall not be published and their names shall be replaced by AS for the first claimant and MS for the second claimant. The name of the litigation friend shall be replaced by S.
  3. Pursuant to section 39 Children & Young Persons Act 1933, there shall not be disclosed in any report of these proceedings or other publication the name or address of the Claimants, the Litigation Friend or other immediate family members, or any details (including other names, addresses, or a specific combination of facts) that could lead to the identification of the Claimants in these proceedings. The Claimants and the Litigation Friend shall be referred to as set out at paragraph 1 of this Order.
  4. Pursuant to CPR 5.4C(4):
    a. A person who is not a party to the proceedings may not obtain a copy of a statement of case, judgment or order from the Court records unless the statement of case, judgment or order has been anonymised in accordance with subparagraphs 1 and 2 above
    b. If a person who is not a party to the proceedings applies (pursuant to CPR r.5.4C(1B) or (2)) for permission to inspect or obtain a copy of any other document or communication, such application shall be on notice to the
    Claimants.
  5. The Court file shall be clearly marked with the words “An anonymity and reporting restrictions order was made in this case on 2 July 2025 and any application by a non-party to inspect or obtain a copy document from this file
    must be dealt with in accordance with the terms of that Order.”
  6. Any person affected by this order may apply on notice to the parties to vary or discharge this Order.
  7. Pursuant to the ‘Practice Guidance: Publication of Privacy and Anonymity Orders’ issued by the Master of the Rolls dated 16 April 2019 a copy of this Order shall be published on the Judicial Website of the High Court of Justice (www.judiciary.uk). For that purpose, a court officer will send a copy of the order by email to the Judicial Office at judicialwebupdates@judiciary.uk 15 Litigation friend 8. S is appointed as the first Claimant’s litigation friend.

  8. A copy of the claimants’ application notice dated 26 June 2025 must be served by the claimants on the parties in claim AC-2025-LON-000997 by 4pm on 3 July 2025. If the claimants do not have the information necessary to do that, the defendant shall either provide the claimants with that information, or shall, alternatively, serve the claimants’ application on the parties in claim AC-2025-LON-000997. The parties to the claim shall be told that they may make any representations in respect of the application, but such representations must be
    filed with the court by 4pm on 9 July 2025.
  9. The Respondent must file an Acknowledgement of Service, Summary Grounds, and written submissions in response to the application notice dated 26 June 2025 by 9 July 2025.
  10. A hearing shall be listed as soon as practicable after 10 July 2025 in order to determine the claimants’ application notice dated 26 June 2025. The parties shall, by 12 noon on the day before the hearing, file an agreed hearing bundle, bundle of authorities and skeleton arguments.
  11. Costs reserved.

    Reasons
    The interests of the parties in claim AC-2025-LON-000997 are affected by the order that the claimants seek. They should have an opportunity to make representations. I have made directions accordingly.
