Order

IT IS HEREBY ORDERED THAT

  1. There be substituted for all purposes in this claim, in place of reference to the Claimant by name, and whether orally or in writing, reference to the letters ASB.
  2. The Court file is to be retained by the Court and marked ‘Anonymised’. Pursuant to CPR 5.4C, a person who is not a party to these proceedings may obtain a copy of pleadings, a Judgement or Order from the Court records only if the pleadings, Judgment or Order has been anonymised such that the Claimant is referred to as RBX in those documents and his address or information from which his identity or address could be discerned has been removed.
  3. Reporting restrictions apply so as to the disclosing of any information that may lead to the subsequent identification of the Claimant. In particular, disclosure of the Claimant’s name or address is prohibited.
  4. Pursuant to CPR 21.2(3) Claimant is permitted to bring this claim in the absence of a litigation friend having been appointed.
  5. The claim is suitable for expedition and the timeframe for the Defendant’s Acknowledgment of Service is abridged to 14 days from the date of this Order.
  6. Upon receipt of the Defendant’s Acknowledgment of Service or the expiry of the time within which it is due, whichever is sooner, the papers will be passed to a Judge to determine the Claimant’s applications for permission and interim relief.
  7. Liberty to apply to vary or discharge this order upon providing 48 hours notice to the other party of any intention to do so.
  8. Costs reserved.

Reasons

  1. The material set out in the Claimant’s statements of facts and grounds justifies the making of an anonymity order on the basis that he advances a case that he is under the age of 18. Further, I accept that an order dispensing with the need for a litigation friend is appropriate in all of the circumstances and that the determination of permission and the application for interim relief should be expedited.
  2. For the avoidance of doubt, this order is not to intended as an indication that I take any view on the merits of the Claimant’s application for permission.
