Order

UPON the claimant having applied for judicial review of an age assessment, dated 30 June 2023, which determined that the claimant’s date of birth was 25 July 2001.
AND UPON the defendant conceding that the claimant is his claimed age with a date of birth of 26 May 2007.
AND UPON the defendant therefore taking steps forthwith to reaccommodate the claimant as a looked after child in accordance with section 20 Children Act 1989
IT IS DECLARED THAT

  1. The claimant’s date of birth is 26 May 2007.

    IT IS ORDERED THAT
  2. Pursuant to rule 39.2 of the Civil Procedure Rules, the identity of the Claimant shall not be disclosed directly or indirectly and this matter shall be known as R (ASK) v Slough Children First.
  3. The claim for judicial review is withdrawn with no need for further formality.
  4. The defendant shall pay the claimant’s reasonable costs, to be assessed if not agreed, and shall make a payment on account of those costs in the sum of 50% of the bill of costs as drawn, within 28 days of receipt of the bill of costs.
  5. There be detailed assessment of the claimant’s publicly funded costs.
