Order

On an application by the Claimant for anonymity and expedition

Following consideration of the N461, N244, grounds and supporting documents filed on behalf of the Claimant.

ORDER by the Honourable Mr Justice Jay

1. Pursuant to CPR rule 39.2, the Claimant shall be anonymised in these proceedings and be referred to only as AWK. Nothing may be published which may lead to his identity being ascertained.

2. The time for the Defendant’s AOS and summary grounds of defence be abridged to 7 days from the date of service of this Order.

3. As soon as possible thereafter, the papers be referred to a High Court judge for determination of the application for permission and, if appropriate, any case management directions. The Claimant’s application to join any further Claimants to this claim to be determined on the same occasion.

4. Liberty to apply to discharge or vary this Order on 24 hours’ notice in writing to the other party and the Court.

5. Costs reserved.

Reasons

1. It is appropriate to make an order for anonymity in this case and an order abridging time for the AoS. Any further expedition in relation to this claim to be determined by the Judge deciding the permission application.

2. The Claim form names only one Claimant. If there are to be more than one, a properly constituted application should be made.
