Order

On an application by the parties
Following consideration of the documents lodged by the Claimant and the Defendant
ORDER by Sir Ross Cranston sitting as a High Court judge

  1. The Tomlin Order settling this claim submitted by the parties is approved and the matter stayed pursuant to the Order.
  2. The confidential schedule to the Tomlin Order to be marked ‘confidential’ on the court file.
  3. The substantive hearing on 6 June 2023 to be vacated in light of the settlement.
  4. An anonymity order is approved in the form of the Annex to this Order.

Reasons

An anonymity order for both Claimant and Defendant is justified in this case given the right to lifelong anonymity held by the complainant in the underlying disciplinary proceedings under section 1 of the Sexual Offences (Amendment) Act 1992. The case may attract publicity, and revealing the identity of the Claimant and the Defendant may lead to the identification of the complainant: see AB v The University of XYZ [2020] EWHC 2980 (Admin).
