BEFORE HHJ Richard Roberts sitting as a Judge of the High Court on 29th November 2023
UPON hearing Satinder Hunjan KC, Leading Counsel for the Claimant and Vaughan Jacob, Counsel for the Defendant
AND UPON the parties having reached terms subject to the approval of the Court by way of the Claimant accepting the Defendant’s offer of £3,000,000 on 3rd August 2023 at a Joint Settlement Meeting.
AND UPON the parties agreeing that the Claimant’s entitlement to further costs pursuant to her Precedent T is to be determined as part of the detailed assessment
AND UPON reading the Advice of Satinder Hunjan KC dated 24th August 2023
WHEREAS the Claimant has made a claim (“the claim”) against the Defendant for personal injuries arising out of the Defendant’s negligence whilst driving a motor car on 20th July 2017.
AND WHEREAS judgment was entered in favour of the Claimant by way of Order dated 9th February 2021.
AND WHEREAS the Court is satisfied that a final lump sum award is an appropriate form of award in this matter.
IT IS ORDERED AND APPROVED that:
- The Claimant may accept the sum of £3,000,000 gross in full and final settlement of her claim against the Defendant.
- The sum of £3,000,000 be satisfied as follows:
a. The Claimant gives credit for interim payments received in the sum of £222,500.
b. The Claimant gives credit for recoupable benefits received in the total sum of £82,131.90.
c. Pursuant to CPR 46.4(5)(b), the success fee payable by the Claimant to her Solicitors is summarily assessed in the sum of £115,000 and is to be paid to the Claimant’s Solicitors by 4pm on 20th December 2023.
d. The deduction in respect of the Claimant’s ATE Premium is approved in the sum of £1,008 and is to be paid to the Claimant’s Solicitors by 4pm on 20th December 2023.
e. The sum of £120,000 to be paid to BXYZ in respect of past gratuitous care provided by them to the Claimant.
f. The sum of £2,579,360.10 (to include the past gratuitous care) be paid into the Claimant’s deputyship account by 4pm on 20th December 2023.
- The Defendant shall pay the Claimant’s costs (to include such costs as may be allowed in respect of the disputed Precedent T at the detailed assessment) subject to a detailed assessment on the standard basis if not agreed.
