ORDER by the Honourable Mr Justice Lavender
1. Pursuant to rule 39.2 of the Civil Procedure Rules, the identity of the Claimant shall not be disclosed directly or indirectly and this matter shall be known and listed as R (AY) v Royal Borough of Greenwich.
2. With effect from 22 July 2024, and until the determination of the Claimant’s age or further order, the Defendant shall treat the Claimant in accordance with his claimed age and, as soon as practicable, make provision for him to be treated in accordance with his claimed age under the Children Act 1989.
3. Costs reserved.
Reasons
1. The facts and matters relied on by the Claimant indicate that there is a serious issue to be tried. It is unnecessary to wait until the permission application has been determined.
2. The balance of convenience favours the grant of interim relief. The potential harm to the Claimant concerns his personal development and well-being, whereas the potential harm to the Defendant and its council tax payers concerns resources.
